BNSF wins dispute with union over labor availability
In January 2022, BNSF implemented a new point-basis attendance policy, which disciplines workers after all the points are used. Two locomotive union groups, SMART-TD and the Brotherhood of Locomotive Engineers and Trainmen, were upset over the new policy, labeling it as "anti-worker" and "unsafe." In the latest court ruling, the U.S. District Court ruled that the policy is a minor dispute under the federal Railway Labor Act, making it illegal for unions to go on strike. The current unions are in the process of considering an appeal to the new policy.
